Petitioner seeks bail in a case registered for the offences punishable under Sections 392/34 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, it came to light that petitioner used the looted mobile and earlier he was made accused in Hisua P.S. Case No. 47 of 2015. Admittedly, petitioner is in jail custody since 19.02.2016 but up till now, he has not been put on Test Identification Parade. Moreover, there is nothing in the impugned order to show that looted mobile had been recovered from

Patna High Court Cr.Misc. No.14390 of 2016 (2) dt.07-04-2016 2/2 possession of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Reshma Verma, Judicial Magistrate 1st Class, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 62 of 2015. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
