JUSTICE SATYAVRAT VERMA ORAL ORDER 28-06-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State along with learned counsel for the informant. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner being the husband has been falsely implicated in the present case, it is next submitted that the petitioner is a poor person and thus is not in a position to maintain the children and the informant.

Learned counsel for the informant rebuts the submission of the learned counsel for the petitioner and submits

No.6696 of 2023(5) dt.28-06-2023 2/2 that initially when the matter was taken up on 24.05.2023, a submission was made on behalf of the petitioner that the children will stay with him and the said submission was made based on the pleadings made in the petition, it is next submitted that the said submission of the learned counsel for the petitioner was disputed, accordingly, this Court directed the Superintendent of Police, West Champaran, to get a report from the concerned S.H.O. of the P.S.

Learned counsel for the informant next submits that form perusal of the report submitted by the S.H.O. of the concerned P.S., it would manifest that out of the wedlock three children were born and all the three children are dependent and staying with the informant.

Learned counsel for the informant thus submits that a false submission was made before this Court on the previous occasion.

Considering the submission, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner. (Satyavrat Verma, J) HarshPandey/- U T
