JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 The petitioner seeks regular bail in connection with Kudra P.S. Case No. 186 of 2019, registered for offences punishable under Sections 302/34 of the Indian Penal Code. Prosecution case is that petitioner and other accused persons caught hold of the sister of the informant and coaccused Ganesh Paswan stabbed her causing her death. It has been submitted on behalf of the petitioner that the F.I.R. itself disclosed that there is no allegation against the petitioner of stabbing the sister of the informant rather the same is attributed to the co-accused of this case. Further submission is that he has been in custody since 08.07.2019 and other accused persons have already been enlarged on bail by a coordinate Bench of this Court vide order dated 27.11.2019 passed in Cr. Misc. No.76742 of 2019.

Having heard both sides, in view of the submissions as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VI, Bhabhua, Kaimur, in connection with Kudra P.S. Case No. 186 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
