JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 The petitioner is languishing in custody since 25.02.2015 in connection with Ghanshyampur P.S. Case No. 32 of 2015 for the offences instituted under Sections 20 and 22 of the N.D.P.S.Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the informant received secret information that petitioner was selling Ganja. On that information, informant along with other police force raided the house of the petitioner and recovered 2.00 Kg. Ganja from the house of the petitioner and prepared seizure list. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.02.2015 and the charge sheet has
Patna High Court Cr.Misc. No.24983 of 2015 (2) dt.20-07-2015 2/2 been submitted in the present case. It is further submitted that two Kg. of Ganja is said to have been recovered from the joint house of the petitioner. It is further submitted that recovered amount is much less than the commercial amount. It has further been pointed out that co-accused have also been granted bail vide Cr. Misc. No. 14851 of 2015.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cumSpecial Judge, Darbhanga, in connection with Ghanshyampur P.S. Case No. 32 of 2015(G.O. Case No. 11/2015).
