Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Paraiya P.S. Case No. 208 of 2019, registered for the offences punishable under Sections 304(B), 201, 34 of the

Patna High Court CR. MISC. No.15453 of 2021(2) dt.17-01-2022 2/3 Indian Penal Code.

As per FIR, the marriage of the informant's daughter was solemnized with co-accused Dinesh Bind on 25.11.2019. The informant got an information that her daughter is not well then she went to matrimonial house of her daughter and there were no male members rather only female members of the village were there. One of the females apprised the informant that the matrimonial inmates of his daughter have committed her murder and after concealing the dead body they had fled away.

Learned counsel for the petitioner has submitted that the real fact is that the daughter of the informant had died due to some ailment and her mother has lodged this case due to mistake. When the informant (mother of the deceased) came to know the real fact, she has filed an affidavit in the court below dated 14.01.2020 in which she has mentioned that due to mistake she has lodged this case and her daughter died due to some ailment. She has further stated that she has no grievance from the accused persons.

Considering the above-mentioned facts and circumstances, let the petitioners be released on anticipatory bail in the event of their arrest or surrender within four weeks before

No.15453 of 2021(2) dt.17-01-2022 3/3 the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 3rd, Gaya in connection with Paraiya P.S. Case No. 208 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
