The petitioner apprehends his arrest in connection with Darbhanga Mahila P.S. Case No. 62 of 2019 for the offence registered under Sections 376/323/504/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The First Information Report is lodged after lapse of three years of the alleged occurrence. It is further submitted that the Annexure-2 reveals that the marriage of the informant was already solemnized with one Bablu Chaupal and she has two daughters. The identity card also shows the informant is wife of one Bablu Chaupal (Annexures-3

It is also submitted that husband of the informant filed a petition in the Court of S.D.M., Sadar Darbhanga, (Annexure8), showing the bad character of informant. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bail bond to the satisfaction of the S.D.J.M., Darbhanga in connection with Darbhanga Mahila P.S. Case No. 62 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
