JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 23-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Rafiganj P.S. Case No. 193 of 2018 registered under Sections 341, 323, 307, 504 and 324 read with 34 of the Indian Penal Code.

Considering that there is a case and counter case and the injuries sustained by the members of the prosecution party were found simple in nature as stated in Para-7 of the application and certain members of the prosecution party have already been granted pre-arrest bail in the the counter case by this Court vide order dated 08.01.2019 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.2939 of 2019(2) dt.23-01-2019 2/2 78421 of 2018, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Rafiganj P.S. Case No. 193 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
