JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nadi P.S. Case No. 181 of 2022 registered for the offences punishable under Section 366A of the Indian Penal Code. As per the FIR, the petitioner is said to have kidnapped the daughter of the informant.

Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. It is further submitted that victim is a major girl ( Annexure-3). The statement of the victim was recorded under section 164 of the Cr.P.C in which she has supported the prosecution case. It is further submitted that petitioner has clean antecedent as stated in para-3 of this application.

No.6775 of 2023(2) dt.08-05-2023 2/2 Considering the statement of victim recorded under section 164 of the Cr.P.C as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate,1st class, Patna city in Nadi P.S. Case No. 181 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
