Earlier, the bail petition of petitioner was rejected, vide order dated 10.09.2021 passed in Cr.Misc. No. 35064 of 2021 (Annexure-1).

By filing supplementary affidavit, it is submitted on behalf of the petitioner that during trial, out of eight chargesheeted witnesses, three witnesses including informant have been examined and none of them identified this petitioner in dock during their testimony. Petitioner is in custody since 07.12.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody as well as deposition of the witnesses, including informant, the bail
