The petitioner seeks bail in anticipation of his arrest in connection with Piro P.S. Case No. 221 of 2020, dated 14.09.2020, instituted for the offences under Sections 148, 149, 147, 341, 323, 337, 338, 379 and 307 of the Indian Penal Code and Section 27 of the Arms Act. Though he is said to have assaulted one Munna Singh by means of a sharp cutting weapon but according to
Patna High Court CR. MISC. No.15001 of 2021(2) dt.28-02-2022 2/3 the counsel for the petitioner, aforesaid Munna Singh has received lacerated wound which has been reported to be simple in nature.
There is a counter version of the occurrence as well lodged by co-accused/Mahendra Paswan vide Piro P.S. Case No. 222 of 2020.
Three persons are said to have been injured from the side of the petitioners.
All the victims of the subject F.I.R. have received simple injuries. The dispute arose between the two sides over the issue of raising a fence over a water body. Regard being had to the background facts and taking into account that the petitioner does not have criminal antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V, Bhojpur at Ara in connection with Piro P.S. Case No. 221 of
Patna High Court CR. MISC. No.15001 of 2021(2) dt.28-02-2022 3/3 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
