JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Nautan P.S. Case No. 159 of 2014, registered under Sections147, 148, 149, 323, 324, 307, 337 and 504 of the Indian Penal Code, Section 27 of the Arms Act and Section 4/5 of Explosive Substance Act.

The prayer for bail of the petitioner has already been rejected vide Criminal Miscellaneous No. 27277 of 2015 on 07.10.2015 taking into consideration of allegation against the petitioner to cause injury to the injured Harbansh Rai son of the informant on his chest and also at the hand of one Ram Nakashtra Rai.

Learned counsel for the petitioner submits that while

Patna High Court Cr.Misc. No.15319 of 2016 (4) dt.22-06-2016 2/2 there are injury reports, as detailed in the case diary, but the statement of aforesaid injured has not been recorded by the I.O of this case. The Chargesheet has also been submitted on 28.02.2015. The petitioner having no criminal antecedent is in custody since 22.01.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Nautan P.S. Case No. 159 of 2014.
