1. Heard Mr. Niraj Kumar Singh, learned counsel for the petitioner and Mr. Binod Kumar No.3, learned APP for the State.
2. The petitioner apprehends his arrest in connection with Aayar P.S. Case No. 60 of 2023 dated 09.05.2023, registered for the offences punishable under Sections 279, 337, 427, 307, 224, 353, 379, 411 read with Section 34 of the Indian Penal Code.
3. The main submissions advanced by the petitioner's counsel are that the petitioner is not named in the FIR, he has been made accused mainly on account of registered owner of a tractor which is said to have been seized at the spot along with other tractors, in fact, the petitioner had sold his tractor in the year 2018 to the co-accused Munna Kumar but due to some reason, the registration of said tractor could not be transferred,

No.7677 of 2025(2) dt.19-04-2025 2/2 however, the petitioner has filed the copy of the sale deed as Annexure-P/3 showing the sale transaction in between the petitioner and co-accused Munna Kumar. It is further submitted that as per the FIR, one co-accused Munna Kumar is said to have been apprehended but he did not reveal the name of the petitioner as being escaped from the place of occurrence.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions and mainly taking into account the petitioner's fair and clean antecedent, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Aayar P.S. Case No. 60 of 2023 on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
