The petitioner seeks bail in anticipation of his arrest in connection with Khagaria (Gangaur) P.S. Case No. 265 of 2020, dated 02.04.2020, instituted for the offences under Sections 147, 148, 149, 323, 506, 504, 379 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is said to be the order-giver. The act of assault has been attributed to other accused persons. From the perusal of the injury reports brought on record by way of Annexure - 3 series, it appears that only one of the injuries on one of the victims has been reported

Patna High Court CR. MISC. No.14748 of 2021(2) dt.25-02-2022 2/2 to be grievous but rest all injuries on all other victims are simple in nature.

Be that as it may, the petitioner is not stated to be the author of any such injury as he is only alleged to have given orders of assault.

Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Kagaria (Gangaur) P.S. Case No. 265 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
