A counter affidavit has been filed on behalf of the respondent no.7 in which it has been stated that vide Memo No.40, dated 25.01.2020 (Annexure-9), the District Education Officer, Madhepura sent a letter to Director, (Secondary Education), Education Department, Patna, Bihar about grant of

Patna High Court CWJC No.1470 of 2023(4) dt.11-02-2025 2/2 pay protection from the basic pay but till date no order has been passed by the Director, (Secondary Education), Education Department, Patna, Bihar.

Considering the submission of the parties, petitioner is directed to file a detailed representation along with a copy of this order and other supporting documents, before the respondent no.4 within a period of four weeks and the respondent no.4 is well advised to consider the case of the petitioner and dispose of the representation of the petitioner after affording an opportunity of personal hearing or through his counsel and pass a reasoned and speaking order in accordance with law within four weeks from the date of filing of such representation by the petitioner.

It is made clear that respondent no.4 shall be personally held responsible for non-compliance of this order within the stipulated period.

With the aforesaid directions, this writ application stands disposed of.
