Petitioner seeks bail in a case registered under section 414 of the Indian Penal Code.
One stolen motorcycle is said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 6.9.2015.
Earlier petitioner was made accused in four cases out of which he was acquitted in three cases.
The contention on behalf of the petitioner is that petitioner had purchased the said motorcycle and, as a matter of fact, document relating to the aforesaid motorcycle has not been given to the petitioner. It is further submitted that even if the prosecution story assumed to be true, then also, there is no any claimant of the seized motorcycle and the petitioner has sufficiently been punished by
Patna High Court Cr.Misc. No.12245 of 2016 (2) dt.29-03-2016 remaining in jail custody since long.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Sonelal Rajak, Judicial Magistrate, Ist Class, Munger in Dharahra P.S.
