Since the death occurred within seven years from the date of marriage, a case for the offences punishable under Section 304B read with Section 34 was registered against him. He was arrested on 25.03.2014. B.A. No.178 of 2014 filed by him before the Court of Additional Sessions Judge-II, Supaul was rejected on 17.04.2014. Hence, this application. Heard learned counsel for the petitioner and learned counsel for the State.

The allegation against the petitioner is no doubt serious since the death of his wife occurred under mysterious circumstances. The fact, however, remains that investigation is completed and the charge-sheet is filed. This Court is of the view that continued detention of the petitioner is not necessary at this

Hence, this application is allowed. The petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Jadiya P.S. Case No.140 of 2012 (G.R. No.1929 of 2012).
