1. Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Chapra Mufassil P.S Case no.277 of 2023 registered under section 393 of the Indian Penal Code.

3. As per the prosecution case, the informant states that over a trivial dispute, the petitioner and one another started to assault the informant. However on halla being raised, the coaccused was caught at the place of occurrence while the petitioner managed to escape.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No such

Patna High Court CR. MISC. No.6771 of 2024(2) dt.17-02-2024 2/2 occurrence as alleged in the FIR took place. Even as per the allegations, the petitioner was not caught at the place of occurrence. He is in custody since 16.8.2023.

5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, his being in custody for 6 months since 16.8.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Chapra Mufassil P.S Case no.277 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
