2. The petitioner seeks pre-arrest bail in connection with Amarpur P.S. Case No. 423/25 registered for the offence(s) punishable under Sections 8,21C,22C,25 of the NDPS Act.

3. As per the allegation made in the FIR, some narcotic substance was recovered from the shop of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and recovery of narcotic substance was not made from the conscious possession of the petitioner, rather the same has been recovered from the shop of the petitioner, which is easily accessible to common

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail and submitted that the anticipatory bail application is not maintainable.

6. Considering the nature and gravity of the allegations under the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the present application stands dismissed.
