The petitioner, who seeks bail in a case registered for the offence punishable under Section 387 of IPC, is in custody since 23.3.20015.
Accusation is of demanding extortion of Rs.11,00,000/- through mobile and giving life threatening. It is submitted that the petitioner is not named in the FIR. Mobile through which the demand was made, has been found registered in the name of Raushan Singh. The name of the petitioner has appeared in the supervision note. The petitioner has also been made accused in other case in which he has not been named and he has been granted bail.
Patna High Court Cr.Misc. No.29510 of 2015 (2) dt.12-08-2015 2/2 It is further submitted that in similar facts and circumstances, co-accused have been granted bail vide Annexure2 and 2 A. Learned counsel for the State could not controvert the contention of the petitioner while opposing his prayer for bail. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahna at Motihari in Madhuban P. S. Case No. 74 of 2014 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
