2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Ahiyapur P.S. Case No.1100 of 2017 registered under Sections 147, 148, 149, 332, 333, 353, 307, 186 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per FIR, 20 named co-accused including petitioner and 250 unknown persons started pelting stones on the police team while the people were protesting by way of strike.

4. It is submitted by learned counsel appearing for petitioner that the allegation qua deterring police officials

Patna High Court CR. MISC. No.3601 of 2026(2) dt.30-06-2026 2/3 from discharging their official duties and also to cause assault is appearing very much general and omnibus against petitioner. It is submitted that name of petitioner was supplied by unknown villagers out of local dispute and differences. It is also submitted the petitioner was not alleged attributing specific role towards occurrence. While concluding argument, it is submitted that one of the similarly situated co-accused person has already been granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No.34068 of 2019 dated 23.05.2019 and, therefore, considering the judicial parity, this petitioner also deserves bail. Explaining criminal antecedent, it is submitted that the petitioner found involved in four more criminal cases, where he is on bail.

5. Learned APP opposed the prayer of bail.

6. In view of aforesaid factual submissions and by taking note of nature of accusation, which is appearing very much general and omnibus in nature, as discussed aforesaid, coupled with the fact that similarly situated co-accused person has already been granted bail by one of the learned

No.3601 of 2026(2) dt.30-06-2026 3/3 co-ordinate Bench of this Court, as mentioned aforesaid, accordingly, the petitioner, above-named, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Ahiyapur P.S. Case No.1100 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure (in short 'CrPC')/under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023 (in short 'BNSS').
