JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 This is an application for grant of anticipatory bail in connection with Fesar P.S. Case No. 40 of 2018, disclosing offences under Sections 147, 148, 149, 188, 341, 323, 386, 504, 506 of the Indian Penal Code.

Allegation as per F.I.R. is that in the light of judgment of this Court passed in C.W.J.C. No. 15665 of 2006, the possession has been given to the informant and when he went along with Bataidar for preparing the land for cultivation of paddy, then the petitioners along with other co-accused persons came variously armed and demanded rupees one lac as Rangdari from the informant and further allegation against the petitioners is of cultivating paddy over the said land.

Submission of learned counsel for the petitioners is

Patna High Court Cr.Misc. No.2589 of 2019(3) dt.07-02-2019 2/2 that they are Bataidar and parcha has been given in favour of them and they have falsely been implicated in this case. Heard learned A.P.P. also.

Having heard both sides, considering the above facts and circumstances of the case, this application is disposed of with a direction to the petitioners to surrender before the court below and make prayer for regular bail, which shall be considered on the basis of submission as made above and the learned court below is to verify the parcha issued in favour of the petitioners and also judgment passed in Title Suit No.119/96 and after verifying the facts, shall pass an appropriate order, if possible, on the same day.
