JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 15.12.2014 in a case registered for the offences punishable under Sections 399,402,414 and 120B of the Indian Penal Code, section 25(1-B)a 26(II) and 35 of the Arms Act and sections 20 and 22 of NDPS Act.
On information that the miscreants are preparing to commit dacoity, the raid was laid when from the possession of the petitioner one loaded country made pistol, one cartridge and one mobile were recovered and from other accused persons also certain recoveries were made.
Considering the fact that investigation has concluded, let the above named petitioner be released on bail on furnishing bail
Patna High Court Cr.Misc. No.23509 of 2015 (2) dt.13-07-2015 2/2 bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Muzaffarpur in connection with Saraiya P.S. Case No. 474 of 2014.
Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults, without any reasonable cause, on two consecutive occasions.
