Earlier the petitioner had moved for grant of anticipatory bail and that has been dismissed for noncompliance of order dated 10.1.2018 passed in Cr. Misc. No.59316 of 2017 .
Submission of the learned counsel for the petitioner is that as a matter of fact no case is made out against the petitioner and as such the police after investigation has submitted final form but on protest the cognizance has been taken. Further submission is that as a matter of fact the petitioner is an old man and he could not know about the order of dismissal for non-compliance in Criminal Miscellaneous
Patna High Court CR. MISC. No.13035 of 2019(4) dt.11-07-2019 2/2 Application and as soon as he came to know about the same, he approached this Court. .
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances and the conduct as stated above, I am not inclined to grant anticipatory bail to the petitioner but considering submission, let the petitioner surrender before the learned court below, who will consider the materials against him and dispose of the application if possible on same day. With the aforesaid direction, this application is disposed of.
