The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

An F.I.R. was lodged against unknown after recovery of the dead body of Johra, the wife of Md. Imteyaz. One Md. Rayees was apprehended, who confessed his guilt and disclosed the name of Md. Imtiyaz, the husband of the deceased, and three other accused persons including the petitioner. It is stated that the blood-stained Dabiya was recovered from the house of the petitioner and chargesheet is submitted but the Dabiya has not yet been sent for FSL report. Save and except the confession of the co-accused, the police did not collect any further material. The petitioner is in jail since 12.03.2015.

Considering the facts aforesaid and the fact that other

Patna High Court Cr.Misc. No.23703 of 2015 (4) dt.24-09-2015 2/2 accused persons have already been enlarged on bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Jokihat P.S.
