The petitioner apprehends his arrest in connection with Tajpur (Halai O.P.) P.S. Case No.514 of 2022 registered under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery of liquor has been made from Wagon R and Bolero Pick-up van in question. The petitioner is neither the driver nor the owner of the seized vehicles and has no concern with the seized liquor.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.4777 of 2023(2) dt.28-04-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Court No.2, Samastipur in connection with Tajpur (Halai O.P.) P.S. Case No.514 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
