JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2019 This is an application for grant of anticipatory bail in connection with Shahpur P.S. Case No. 370 of 2018, disclosing offences under Sections 376, 511, 509, 379 of the Indian Penal Code.

Allegation against the petitioner is of taking the informant along with other co-accused persons and trying to outrage her modesty and after snatching mobile phone fled away.

Submission of learned counsel for the petitioner is that no case is made out under Section 376 I.P.C. and there is also delay in lodging the F.I.R.

Heard learned A.P.P. also.

Having heard both sides, considering the above facts and circumstances of the case, let petitioner surrender before the

Patna High Court Cr.Misc. No.3376 of 2019(3) dt.08-02-2019 2/2 court below within a period of six weeks from the date of receipt of the order and pray for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible, to be disposed of on the same day.
