The petitioner apprehends his arrest in a case registered under Sections 420 and 468 IPC.

The informant who is a blind lady has alleged that the petitioner and one Sanjay Kumar Mahto took her to Begusarai on the pretext of treatment of her eyes but they took her thumb impression and LTI on a paper and got a sale deed executed relating to her lands and when her grand son and daughter-in-law came to know and went on the spot, the accused persons assaulted them. The petitioner is witness to the sale deed. It has been submitted on behalf of the petitioner that the petitioner is the witness to the sale deed. Except for that, no other allegation has been made against the petitioner. It has further been submitted that the allegation is of civil nature. It is also submitted that co-accused has already been released on bail vide Annexure-2 to this petition.

Considering the aforesaid facts and circumstances, petitioner, named above, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Dwivedi, Judicial Magistrate, Ist. Class, Begusarai in connection with Complaint Case No.1855-C- of 2013, subject to conditions as laid down under section 438(2) of the Cr.P.C.
