JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant. Petitioner seeks bail in a case registered under Sections-380, 307 & other minor sections of the Indian Penal Code.
Petitioner is said to have given farsa blow, causing head injury to informant but in medical examination, one lacerated would, said to be caused by hard and blunt substances, was found on the head of the informant of the present case. Learned counsel, appearing for petitioner submits that prior to the alleged occurrence, the prosecution party assaulted the petitioner and others, for which, a criminal case was lodged against them and in retaliation to the aforesaid case; the
Patna High Court Cr.Misc. No.13996 of 2016 (2) dt.05-04-2016 2/2 informant lodges this false case against the petitioner and others. On the other hand, learned counsel, appearing for the informant submits that the informant of the present case, sustained serious injury and he was referred to PMCH, where his treatment is still going on.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Desari P.S. Case No. 04 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
