====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with ExciseGR-419 of 2019 (CIS-Excise-443 of 2019), arising out of Brahampur P.S. Case No.192 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The accusation is that on receiving the secret information about keeping of the liquor by Putul Singh, Dinesh Yadav and Dharmendra Yadav (petitioner) in the cowshed of Putul Singh in village-Balua, the informant along with other police personnel reached there and recovered 27 cartoons, each containing 48 bottles of 180 ml. Indian Made Foreign Liquor,

Patna High Court CR. MISC. No.2786 of 2020(2) dt.24-01-2020 2/2 kept in basement of the cowshed of Putul Singh, while none was present there.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was apprehended in Brahampur P.S. Case No.472 of 2018 of the similar nature of case, due to that reason, the petitioner has falsely been implicated in this case by the police on mere suspicion. The petitioner has been remanded in the present case on 29.11.2019 and since then he is in custody.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge (Excise), Buxar, in connection with Excise GR-419 of 2019 (CIS-Excise-443 of 2019), arising out of Brahampur P.S. Case No.192 of 2019.
