2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 88.8 litres Nepali sufi wine was recovered from the seized vehicle.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case merely on suspicion. No incriminating article has been recovered from conscious possession of this petitioner. Petitioner is neither owner nor driver of the vehicle in question.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to

Patna High Court CR. MISC. No.7945 of 2025(2) dt.06-03-2025 2/2 the petitioner and submitted that petitioner is named in the F.I.R. and has also got five criminal antecedents out of which four are of similar nature.

6. Considering the aforesaid facts and circumstances, huge quantity of recovery and the fact that petitioner has got five criminal antecedents out of which four are of similar nature, the prayer for grant of anticipatory bail to the petitioner is rejected.
