JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2017 Heard Mr. Abninav Srivastava, learned counsel appearing on behalf of the petitioner and the counsel appearing on behalf of the respondents.

Mr. Srivasvata submits that after Marathon effort and the direction of the writ court, respondents have passed order on 2.6.2016. However, monetary benefit arising out of Annexure-10 has not reached the petitioner.

In view of the recital of Annexure-10 there is no dispute as to the entitlement of the petitioner. The entitlement of the petitioner has been verified by the official of the State Government and in that view of the matter there is no impediment

Patna High Court CWJC No.9811 of 2017 (2) dt.21-12-2017 2/2 in making payment of lawful dues of the petitioner. Accordingly, the writ petition is disposed of with direction to the Director, Higher Education, Bihar who shall ensure payment of monetary benefit of the petitioner arising out of the order contained in Annexure-10 within a maximum period of three months from the date of receipt/production of a copy of this order. In this process, the Director, Higher Education is required to convene meeting of the officials of the University namely, Registrar and Finance Officer of B.R.Ambedkar Bihar University, Muzaffarpur. In the event, the monetary benefit arising out of Annexure-10 is not paid within the time frame indicated hereinabove, the petitioner shall be entitled to payment of interest @ 9 per cent per annum from the date of its accrual to the date of actual payment and respondents after making payment of interest shall realize the interest component from the persons responsible for delay in implementing the order of the State Government contained in Annexure-10.

With the aforesaid, the writ application stands disposed of.
