JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Chakai P.S. Case No. 97 of 2012, registered under Section 394 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been disclosed by co-accused Uma Hazra, but no incriminating has been recovered from the possession of the petitioner. Further submission is that there is nothing against the petitioner to show his involvement in the present case, except the confessional statement. Further submission is that while the petitioner is accused in Dumka Town P.S. Case No. 130 of 2012 registered

Patna High Court Cr.Misc. No.13778 of 2016 (2) dt.25-04-2016 2/2 under Section 399 and 402 of the Indian Penal Code, but he is on bail in that case. The petitioner is in custody since 11.01.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Chakai P.S. Case No. 97 of 2012. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
