JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

Petitioner is said to be caught by the informant and others with stolen she-buffalo but submission on behalf of the petitioner is that petitioner had purchased the she-buffalo from the informant but later on, some dispute arose between them and after that the informant lodged this false case. It is further submitted that petitioner was earlier made accused in Suryapura P.S. Case No. 57 of 2010 and except the aforesaid case, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.15216 of 2016 (2) dt.12-04-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Agiaon Bazar P.S. Case No. 08 of 2016.
