The petitioner seeks bail in Masaurhi P.S. Case No. 50/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

Nilam Kumari, the widow of the deceased made allegation that her husband had gone with Ramdeo Das, Basdo Das and Moti Das who had taken Rs. 8 lacs from her husband for providing job but her husband did not return. She called her husband who disclosed that he was with Basdo Das and Ramdeo Das. Thereafter the switch of the mobile was off. The petitioner is not named in the FIR.

It is submitted that except the confessional statement of Ramdeo Das, there is no material against the petitioner. The

Patna High Court Cr.Misc. No.23785 of 2015 (3) dt.24-09-2015 2/2 petitioner has no manner of concern with the accused persons or the informant. In pursuance of the confession of Ramdeo Das, the dead body was recovered. Save and except the confession of Ramdeo Das, no other material is collected against the petitioner. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Masaurhi, Patna, in connection with Masaurhi P.S. Case No. 50/2014.
