The petitioner seeks regular bail in connection with Ramakrishna Nagar P.S. Case No. 458 of 2018, registered for the offence punishable under Sections 365 and 34 of the Indian Panel Code.
The allegation is regarding five miscreants having kidnapped the informant and his brother-in-law and having taken them in a car outside Patna, however, the vehicle had to stop near village Raily on account of road blockage and at that time, the police came and surrounded the vehicle and caught the miscreants.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case
Patna High Court Cr.Misc. No.8990 of 2019(2) dt.18-02-2019 2/2 inasmuch as he is merely the driver of the said vehicle and has got nothing to do with the alleged incident. It is further submitted that the petitioner is having a clean antecedent, hence, benefit of doubt can be given to the petitioner herein. It is further submitted that the petitioner is languishing in custody since 29.10.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge XIII cum Additional Chief Judicial Magistrate, Patna in connection with Ramkrishna Nagar P.S. Case No. 458 of 2018.
