JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Learned Additional Public Prosecutor has produced report submitted by the Senior Superintendent of Police, Patna wherefrom it is evident that out of eight prosecution witnesses, six have already been examined. With regard to remaining, Manorma Devi and Dr. Pankaj Kumar, it has been disclosed that same will be produced on next date positively. In the aforesaid background, learned counsel for the petitioner submits that instant petition be decided.
Taking into account the status of the petitioner to be husband of deceased coupled with the fact that the majority of the prosecution witnesses have already been examined as well as being it a case of dowry death, petitioner does not deserve bail.
Hence, prayer for bail is rejected.
