JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402, 414 of the Indian Penal Code, 25(1-b)a/26/35 of the Arms Act and 17 of the Cr. Law Amendment Act. One dagger is said to have been recovered from conscious possession of the petitioner, but the learned court below has committed error in the impugned order giving this finding that country made pistol, dagger etc. were recovered from conscious possession of the petitioner. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 25.12.2015.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.14117 of 2016 (2) dt.05-04-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. Case No.337 of 2015.
