The petitioner is in custody in a case registered under Sections 302/34 of the Indian Penal Code.

The prosecution case in, brief, is that on 3.3.2015 at about 4.15 A.M., the informant Munni Devi gave her fardbeyan before O/C of Moihania Police Station alleging therein that on 2.3.2015 his son Anil Kumar Yadav was seen by her younger son, namely, Sunil Kumar Singh, that the deceased was called and going with the petitioner on a motorcycle. The informant further alleged that during search of his son she asked the Tinku but he did not say anything. Thereafter she saw, during search, the dead body of his son in the wheat field. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It is further submitted that except last seen there is no other material to indicate the involvement of the petitioner. It is further submitted that the petitioner has no criminal antecedent and is in custody since 4.3.2015.

It has been submitted on behalf of the State and the informant that the petitioner is named in the FIR. Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabhua in Mohania P.S.Case No. 72/2015.
