JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Khaira P.S. case No. 237 of 2015, disclosing offences under Sections 341,323,307,504,506 read with Section 34 of the Indian Penal Code.
Allegedly, when the informant objected installation of electric pole in his land, the FIR named accused persons assaulted him at the instance of co-accused Bhim Paswan. From perusal of the First Information Report, there is no allegation of any assault caused by this petitioner. Petitioner has no criminal antecedent as stated in paragraph 3 of the application.
Considering the above, this application is allowed. Let
the petitioner above-named, in the event of his arrest/surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 237 of 2015, subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and the event of failure on his part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
