The petitioner is languishing in custody since 29.03.2015 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. On hearing the sound of firing the informant came out of his shop and found 2-3 persons fleeing away while firing. The informant claimed to have identified the miscreants by face. The informant reached to the place of occurrence and found his brother-in-law Devesh Kumar lying with bullet injury, who subsequently succumbed to the injuries.
It is submitted by learned counsel for the petitioner that only on confession of the co-accused the petitioner
Patna High Court Cr.Misc. No.24275 of 2015 (2) dt.20-07-2015 2/2 has been roped in the present case but no substantial material has been collected against the petitioner during investigation. The petitioner has not been put on TIP in spite of the fact that the informant claimed to have identified the miscreants by face and the investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Danapur, District - Patna in connection with Paliganj P.S. Case No. 47 of 2015.
