The petitioner is accused in connection with Samastipur (M) P.S. Case No. 236 of 2014, registered under Section 394, 412, 414, 216(A) of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation the Police got recorded the confessional statement of co-accused Rajesh Sahni in connection with Samastipur P.S. Case No. 242 of 2014, who disclosed the name of the petitioner and three others and thereafter, the petitioner has been remanded in the present case on 27.06.2014. Further submission is that while the informant has claimed to identify the culprits on seeing them again, but the petitioner has not been put on T.I.P. The petitioner

Patna High Court Cr.Misc. No.17617 of 2016 (2) dt.03-05-2016 2/2 is accused in 14 other cases, as detailed in para 3 of the petition and due to that reason, the Police also implicated this petitioner in the present case. Further submission is that similarly situated co-accused, Rajesh Sahani @ Rajesh Kumar Sahni, Birju Sahni, Gaurav Thakur @ Gaurav Kumar @ Kumar Gaurav and Lalita Devi have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 29.02.2016, 08.01.2015, 03.04.2015 and 04.12.2014 passed in Criminal Misc. Nos. 6643 of 2016, 37877 of 2014, 51346 of 2014 and 44736 of 2014, respectively.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with Samastipur (M) P.S. Case No. 236 of 2014. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
