JUSTICE ASHUTOSH KUMAR) 18-11-2022 Heard Mr. Rajiv Kumar Labh, the learned Advocate for the petitioner and Mr. Alok Ranjan, the learned Advocate for the State.
The license of the petitioner has been cancelled, which order has been challenged in the petition. Though several grounds have been raised by the petitioner but considering the fact that statutory provision of appeal has not been exhausted by the petitioner, we are
Patna High Court CWJC No.24120 of 2018(2) dt.18-11-2022 2/2 not inclined to entertain the present petition. The petition is dismissed but with a liberty to the petitioner to prefer an appeal against the order passed by the Licensing Officer.
Should such an appeal be filed within a period of 30 days, the Appellate Authority after affording sufficient opportunity to the petitioner to present his case, shall pass a reasoned order within a further period of 60 days giving reasons in support of the decision taken by him. The order so passed by the Appellate Authority shall be made available to the petitioner forthwith. The writ petition stands disposed of accordingly.
