JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. There is case and counter case between the parties and according to prosecution case, petitioner no. 3 gave blow of butt of gun on the head of the deceased and so far as petitioner no. 2 is concerned, it is alleged that he gave lathi blow on the hands of the informant. So far as petitioner no. 1 is concerned, it is alleged that he is an order giver.

Admittedly, after investigation, police submitted charge sheet under Section 304 and other minor sections of the Indian Penal Code.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.11592 of 2015 (4) dt.22-05-2015 well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 100 of 2014.
