The petitioners seek bail in connection with Paliganj P.S. Case No.295 of 2022 registered for the offence under Sections 341, 323, 307, 379, 504/34 and 302 of the Indian Penal Code.

3. As per FIR, the allegation against the petitioners is that they started assaulting the informant and her husband due to which, her husband succumbed to injury. 4.

Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated

Patna High Court CR. MISC. No.12373 of 2024(2) dt.27-02-2024 2/2 in this case. He next submits that there is land dispute between the parties and the petitioners were present at the time of occurrence and both parties are agnates and close relative. He next submits that similarly situated co-accused persons have also been granted bail by a Co-ordinate Benches of this Court passed in Cr. Misc. Nos. 3689 of 2023 and 6674 of 2023. Petitioners have got clean antecedent as stated in para-3 of the petition and they are in custody since 09.08.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and also the fact that similarly situated co-accused persons have already been granted bail by a Co-ordinate Benches of this Court, let the petitioners, above named, be directed to be released on bail in connection with Paliganj P.S. Case No.295 of 2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, Patna.
