2. The petitioner is apprehending his arrest in a case in connection with Bidupur P.S. Case No. 403 of 2023 dated 13.07.2023 registered for the offences punishable u/ss 457 and 380 of the Indian Penal Code and u/s 411 of the Indian Penal Code added later on.
3. As per the prosecution case, unknown miscreants are alleged to have committed theft in the house of the informant's brother and stolen jewellery worth Rs. 7,00000/- and Rs. 1,00000/- in cash.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the
Patna High Court CR. MISC. No.3891 of 2025(2) dt.25-04-2025 2/2 petitioner has sprung up in this case in the confessional statement of the co-accused, Sanjay Kumar. No incriminating article has been recovered from the possession of the petitioner. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The co-accused has been granted anticipatory bail by this Court vide order dated 13.02.2024 passed in Cr. Misc. No. 1348 of 2024.
5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 403 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
