The petitioner seeks bail in Amnour P.S. Case No.130 of 2019 registered for the offence punishable under Sections 399, 401 of the Indian Penal Code and Section 25(1-b)(a)/26/35 of the Arms Act.

As per prosecution case, the petitioner was arrested, while preparing planning for committing dacoity and one country made pistol and four live cartridges were recovered from his waist. Apart from that he is also accused five other cases having similar nature of offences.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he is in custody since 18.05.2019. Further submission is that nothing incriminating article has been recovered from the

Patna High Court CR. MISC. No.5881 of 2020(2) dt.03-02-2020 2/2 conscious possession of the petitioner Heard learned Addl. Public Prosecutor.

Be that as it may, considering facts and circumstances, as stated above, I am not inclined to enlarge the petitioner on bail at this stage. Once the charge is framed, the petitioner may renew his prayer for bail.
