Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. It is alleged that FIR named accused and several unknown persons including the petitioner assaulted the police party including the informant and got released one person who had been caught by the informant and other police officials in a theft case. The present case was lodged on the basis of written report submitted by ASI of Chand police station and in the aforesaid written report, no specific overt-act has been attributed against the petitioner.

However, in course of investigation, it came to light that it was the petitioner who gave khanti blow causing head injury to the injured of this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the

No.15400 of 2016 (2) dt.18-04-2016 petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Chand P.S. Case no. 118/2015.
