2. Learned counsel for the petitioner submits that he has received counter affidavit in the said case and humbly requests to this Court that a sympathetic view may be taken into consideration as the petitioner has participated in the advertisement published in the year 2019 but he could not be selected with few marks.

3. In this case State has filed counter affidavit. In

Patna High Court CWJC No.1369 of 2020 dt.23-11-2023 2/2 the said counter affidavit the stand has been taken by the State that the petitioner applied for the post under BC category and got 60.28 merit point, which is below cut off merit point and, as such, the petitioner has no entitlement for selection. The stand has also taken that the selection process of 2019 has completed and another recruitment process has initiated.

4. In this view of the matter, this Court is of the view that no case of the petitioner is made out and this application is dismissed.
