2. The petitioner seeks regular bail in connection with Champa Nagar P.S. Case No. 58/2024 registered for the offences under Sections 103, 3(5) of B.N.S.

3. The prosecution case in nutshell is that the daughter of the informant namely Arati Devi (deceased) was married to Bipin Sharma (petitioner) eight years ago. Thereafter, all the accused persons including the petitioner started torturing the daughter of the informant and on 16.07.2024, the informant received information that all accused persons had killed her daughter.

4. Learned counsel for the petitioner submits that

2/4 petitioner is innocent and has falsely been implicated in this case. From perusal of the case diary, it appears that during the course of investigation police has recorded statement of witnesses who had stated that the victim/daughter of the informant had committed suicide. Learned counsel further submits that the allegation levelled against the petitioner are general and omnibus in nature. It is lastly submitted that the petitioner has clean antecedent and is languishing in custody since 18.07.2024.

5. Learned counsel for the State has opposed the prayer for bail of the petitioner and submits that the petitioner is accused of killing his wife along with other accused persons.

Considering the aforesaid facts and circumstances of the case and taking into account that during the course of investigation several witnesses have stated that the door of the room where the body of the victim was found was closed from inside and the neighbors had brought the body down after opening the door and had stated that the victim had committed suicide, in such circumstances, let the petitioner above-named be enlarged

3/4 on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Purnea in connection with Champa Nagar P.S. Case No. 58/2024 subject to the conditions :- a. One of the bailors of the petitioner shall be his close relative.

b. The petitioner shall remain physically present in Court on each date of the trial.

c. In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to the cancelled by the court concerned.

d. The Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the afore-mentioned order shall not be delayed
