JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 23.08.2014 in connection with Uchakagaon P.S. Case No. 113 of 2014 for the offences instituted under Section 395 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant is the Manager of Manish Petrol Pump. On 25.05.2014 at 8.00 P.M., 06 persons on two motorcycles came on the petrol pump and brought petrol of Rs. 500/- each in their motorcycles. They enquired about the owner of the petrol pump. After that, one person pointed knife in cabin and looted Rs. 1.5 lakh from cash box. They also took out mobile of the informant and they fled way from the scene.

The name of the petitioner has figured in the present case on the basis of confessional statement of co-accused. Further it is submitted that no incriminating article is said to have been recovered from his possession. It is further submitted that the petitioner is in custody since 23.08.2014. It is further submitted that the petitioner may be released on bail after completion of fifteen months in custody.

On behalf of the State, it has been submitted that the name of the petitioner has appeared in the present case in course of investigation and furthermore as many as seven cases of similar nature are pending against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of fifteen months in custody from 23.08.2014 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Gopalganj in connection with Sessions Trial No. 38 of 2015, arising out of Uchakagaon P.S.
